All advertisements are subject to the approval of the Publisher.

Advertiser indemnifies The YGS Group and the Association of Fundraising Professionals (AFP) against losses or liabilities arising from this advertising. The YGS Group assumes no liability whatsoever, except to the extent of a one-time paid advertisement of the same specification, in the next or similar publication, if any proven or admitted errors or omissions have occurred. Full payment is due net 30 days upon receipt of the invoice. Interest shall be charged at 2% per month compounded to yield 26.82% per year on overdue accounts. A charge of $30.00 will be levied against all returned checks. Revisions to previously submitted ad copy are subject to additional charges. In the event of a contract cancellation, the advertiser/or agency agrees to repay The YGS Group any discounts granted on multiple insertions less any discount applicable for the number of insertions completed in the contract. All cancellations must be received in writing prior to the advertising sales deadline. All premium positions are noncancelable. Prices are net of agency commission. Ads may also appear in an online version of the publication(s). The YGS Group is not responsible for errors if a hard copy proof is not submitted with the electronic file. 

Event Terms & Conditions

Contract: The signed Exhibit Form and subsequent notice of assignment constitute a contract (“Agreement”) between the Association of Fundraising Professionals (“AFP”) and the exhibitor (“Exhibitor”). Any point not specifically covered in these terms is subject to the decision of AFP, whose decision shall be final.

Assignments/Allocations: Assignments will be made based on the date the Exhibit Form is received, as well as the selection and the location specifications supplied by the Exhibitor. Location specifications include proximity to other organizations. Priority of selection is given to organizations that have exhibited with AFP in previous years. It is the organization’s responsibility to know its proximity to competing organizations.

Cancellation: The Exhibitor has the right to cancel this Agreement at any time by written notice to AFP. Exhibitors canceling on or before November 1, 2016, will receive a refund of payments made, less a nonrefundable administrative fee of $100. Exhibitors who cancel between November 1, 2016, and December 15, 2016, shall be eligible for a 50% refund. No refunds for cancellations received after December 15, 2016. Under all circumstances, AFP reserves the right to resell any program canceled by Exhibitor.

Exhibit Booth: AFP will provide the following, at minimum: a 10’x10’ standard exhibit booth; two-line identification sign listing company name and exhibit booth number (if requested); an 8’ high backdrop and 36” high draped side walls; aisle carpeting in all main and cross aisles; around-the-clock security beginning with set up and concluding after all freight has been removed; and one full registration per 10’x10’ space rented. Standard in-line exhibit booths may not exceed a height of 4’ in the front half of the exhibit booth. All islands are restricted to a height of 16’, including identification sign. No exhibit is permitted to obstruct the view of  adjacent exhibit booths. Carpeting is mandatory in all exhibit booths. AFP reserves the right to require revisions, at Exhibitor expense, of any exhibit that does not comply with these guidelines.

Use of Space: In keeping with the educational purpose of the International Fundraising Conference, products and services may not be sold for delivery on the exhibit hall floor or other related conference areas during the International Fundraising Conference. No Exhibitor is permitted to promote products, equipment, or services other than its own. If an article of a non-exhibiting firm or business is required for the operation or display of a Exhibitor’s wares, identification of such an article shall be limited to the usual and regular nameplates, imprinting, or trademarks under which the article is sold in the regular course of business. No sub-letting or sharing of space is permitted. All activities must be confined to the limits of the rented or assigned space, and must not impede traffic or interfere with the activity of other Exhibitors. AFP may evict Exhibitors that, due to noise, conduct of personnel, methods of operation, or other reasons, detract from the decorum and general educational character of the International Fundraising Conference.

Use of Logo: The AFP Conference logo is the only logo that AFP grants Exhibitors permission to use. Requests for conference logo use must be submitted in writing to AFP’s Conference  Department with a sample of the piece for approval. Neither the AFP logo nor the AFP Foundation logo may be used for any marketing or other purposes.

Intellectual Property: The Exhibitor hereby agrees that this Agreement does not imply a license or right whatsoever concerning the intellectual property of AFP. For the purposes of this Agreement, “intellectual property” shall mean: all trademarks and service marks registered and/or used by AFP, as well as any right, invention (patented or not), floor plans, industrial designs, utility models, confidential information, commercial names, commercial signs, copyrights, domains, as well as any other intellectual property right protected by law. The

Exhibitor commits not to use, commercialize, disclose, distribute, give away, or by any means use any intellectual property of AFP, except as expressly permitted under this Agreement.

Hospitality: The Exhibitor may use function space for hospitality purposes, subject to Exhibitor’s

formal request to and approval by AFP’s Conference Department, which shall make the assignments. Hospitality functions may not operate during official program hours, which include AFP social activities. The Exhibitor may not display products or equipment, or conduct product demonstrations, in suites or sleeping rooms during the International Fundraising Conference unless they have contracted for the Community Groups Program.

Distribution: The Exhibitor’s distribution of its product/service literature may be made only within its assigned exhibit booth space unless otherwise permitted. Only customary, descriptive product literature and samples may be distributed. Food or drink may be distributed from exhibit booths only with prior written approval from AFP. Organizations that have not purchase an exhibit booth are not permitted to solicit business or display product/service literature of any kind.

Responsibility: If an Exhibitor fails to comply with any aspects of this Agreement, AFP reserves

the right, without prior notice to the Exhibitor, to terminate the Agreement and offer the Exhibitor’s exhibit booth to another party or use it in another manner at AFP’s sole discretion. Exhibitor will still be liable for full payment.

Facilities: The Exhibitor shall not deface or damage any part of the conference facilities. Any costs to repair such damage will be billed to and paid by the Exhibitor. Nothing may be tacked, taped, nailed, screwed, or otherwise posted to the walls, floors, ceilings, furniture, or other property of the conference facilities including the exhibit hall. All setup and dismantling of exhibit booths must be conducted within the assigned space and times. No storage of exhibit materials will be permitted between or behind booth draping.

Safety Codes: The Exhibitor shall comply with all fire codes, safety codes, and union  requirements established at conference facilities. Decorations must be flame-proofed and all hangings must clear the floor. Electrical wiring must conform with National Electric Code Safety Rules and all federal, state, and municipal government requirements. If inspection indicates that an Exhibitor has neglected to comply with these regulations, or otherwise contributes to

fire hazards, AFP reserves the right to terminate this Agreement and cancel at Exhibitor’s expense all or such part of the exhibit that fails to comply.

No Children: No one under the age of 18 is permitted to attend any International Fundraising

Conference events, unless formally invited by AFP (such as award winners, honorees, etc). Any Exhibitor that brings children must take responsibility for its own child care arrangements. Children are not permitted in education sessions, the exhibit hall, or shuttle buses.

Insurance: The Exhibitor is responsible for any claims arising out of its own negligence, or out of the negligence of its employees, representatives, or agents. While AFP will endeavor to protect Exhibitor property through contracted security personnel, the Exhibitor shall be responsible for insuring its own property to full value. AFP assumes no liability for any loss or damage to  Exhibitor property. In holding the International Fundraising Conference, AFP does not act as agent of the Exhibitor, the facility, the general services contractor, or any other party. Claims against any party other than AFP should be submitted directly to the party involved.

Force Majeure and Limitation of Liability: AFP shall not be liable to Exhibitor for any  compensatory, consequential, or incidental damages in the event that any or all of the Events do not take place, in whole or in part, due to cancellation of the Event by AFP or due to any Act of God, or force majeure, including without limitation weather, fire, flood, strike, labor dispute, disease, epidemic or similar cause beyond the control of AFP or Exhibitor. AFP’s liability shall be limited to a return of the fees paid hereunder or a pro rate portion thereof. In the event of any breach of this Agreement by AFP or if for any reason assigned space is not available to Exhibitor during any of the Events or any portion thereof, AFP’s liability shall be limited to a return of the fees paid hereunder or a pro rate portion thereof, and AFP shall not be liable to Exhibitor for any other costs, expenses or damages of any kind resulting directly or indirectly therefrom.

ADA: The Exhibitor shall comply with all laws, ordinances, and regulations pertaining to the Americans with Disabilities Act (ADA) as relates to Exhibitor’s exhibit booth or other contracted space within the conference facilities.

Interpretation: AFP reserves the right to interpret, amend, and enforce these terms as it deems proper to ensure the success of the Exhibitor program and the International Fundraising Conference. AFP makes every effort to ensure that the exhibit hall is in keeping with the educational nature of the International Fundraising Conference. Inclusion of Exhibitor and Exhibitor’s products and services does not constitute, nor should it imply, an endorsement by AFP. Exhibitors may not claim or suggest AFP endorsement of their products or services without a specific, written agreement with AFP.
